01Who qualifies
Who qualifies, generation by generation
LIKELY
Can you claim an Overseas Citizen of India card through a parent?
Overseas Citizen of India (OCI) card
India does not allow dual citizenship, but with an Indian parent, grandparent or great-grandparent you can register as an Overseas Citizen of India: a lifelong right to enter, live, work and study in India. It is not a passport or a vote.
What would settle itNothing on the ancestry side; note that the spouse of an Indian citizen or OCI cardholder also qualifies after two years of marriage.

02Dates that matter
The dates that matter
No date named in India’s rule decides who qualifies. The answers above turn on the family’s facts, not on when anyone was born or left.
03Mothers’ lines
How mothers’ lines were treated
India’s rule gives the same answer whether the line runs through a mother or a father.
04Keeping your citizenship
Dual citizenship with your home country
You keep your citizenship.
On every open route, the rule lets a citizen of the United States, Canada, the United Kingdom, Australia, New Zealand, Brazil, Argentina or South Africa keep that citizenship.

Every route, and the law behind it
The law
What would settle an unsure case
- Nothing on the ancestry side; note that the spouse of an Indian citizen or OCI cardholder also qualifies after two years of marriage.
06The documents
The documents, as the rule lists them
Overseas Citizen of India (OCI) card
Through a parent or grandparent or great-grandparent
- Your ancestor’s Indian passport, birth certificate or domicile certificate
- Birth records linking each generation to you
- Your current passport
Most countries also want proof that no one in the line became a citizen elsewhere before the next birth: the naturalization record with its date, or a letter that none exists.
07What it takes
What it takes: time, cost, the hard part, who decides
Overseas Citizen of India (OCI) card
- Time
- 8–16 weeks once the ancestry documents are assembled; the application itself is online and fast, the document-gathering is the long part.
- Cost
- About $275–350: the OCI application fee plus certified copies and translations of ancestry records.
- The hard part
- Documenting the ancestor's Indian citizenship (or eligibility in 1950) with a period record — a passport, birth certificate or domicile certificate — when the family has scattered or lost the originals over three generations.
- Who decides
- The Ministry of Home Affairs, through the OCI portal or the nearest Indian consulate.
- The first record
- Your ancestor’s Indian passport, birth certificate or domicile certificate, from The state government or municipal record office where they were born or lived, or family papers. Check family papers first; if none survive, write to the municipal corporation or district record office for the birth or domicile record, and to the passport office for any old passport file. ociservices.gov.in ↗
How it’s filed
- Where
- Online at ociservices.gov.in, then the printed file to VFS Global (the outsourced service provider) for pre-scrutiny and onward submission to the Embassy in Washington or the Consulate General for your jurisdiction. VFS Global now runs about 16-17 Indian Consular Application Centres (ICACs) across the U.S. — well beyond the six missions' own cities (New York, Chicago, Houston, San Francisco, Atlanta, Seattle) — including Boston, Columbus, Dallas, Detroit, Edison, Orlando, Raleigh and San Jose, with a Los Angeles centre planned; the exact state-to-centre map for the newer satellite centres isn't published. The missions do not take OCI applications directly. office list ↗
- How
- Online; no appearance needed
- Appointments
- VFS Global OCI services (online account, then submission by post or by prior-appointment drop-off at a VFS centre). An online application older than 180 days is not accepted; submit to VFS well within that window. VFS's general terms treat unauthorized automated/bot use of its site and account-booking systems as misuse leading to account suspension, and multiple third-party reports confirm VFS actively blocks accounts it detects using booking bots — book this yourself. Postal submission to a VFS centre is also available as an alternative to an in-person drop-off.
- Fee
- About $297
- Decision
- 1–5 months
What goes in the file (8)›
- The printed online application with its application number, signed
- Current foreign passport, valid at least six months
- Proof of Indian origin: the parent's, grandparent's or great-grandparent's Indian passport, Indian birth certificate or other proof of Indian citizenship after 26 January 1950
- Birth certificates linking each generation to the applicant
- Photographs and signature in the prescribed format (also uploaded online)
- Proof of address in the consulate's jurisdiction (unverified: per the VFS checklist)
- If the applicant (or the generation link being used) was themselves naturalized as a foreign citizen on or after 2010: a Renunciation/Surrender Certificate of Indian citizenship
- Fees: USD 275 OCI fee + USD 3 ICWF + USD 19 VFS service charge
What goes wrong (8)›
- Not citizenship: no vote, no public office, no agricultural land. It is a lifelong multiple-entry visa with the right to live and work in India.
- Ineligible: anyone who, or whose parent, grandparent or great-grandparent, is or was a citizen of Pakistan or Bangladesh (or certain other countries the MHA specifies).
- From 8 July 2026 only digital OCI cards (e-OCI) are issued to new applicants; reissuance of physical cards has been discontinued.
- The applicant's foreign passport number is tied to the OCI; follow the portal's e-OCI rules when the passport is renewed.
- unverified: current processing time; consulates quote around 45 days and 2026 secondary sources 4–8 weeks, up to about 20 weeks in peak season.
- If claiming through a grandparent, it's the grandparent's — not the intervening parent's — Indian-citizenship evidence that's asked for, and the parent's own foreign naturalization does not itself disqualify the claim; only the applicant's own (or their direct link's) post-2010 naturalization triggers the Renunciation/Surrender Certificate above (secondary confidence: cgisf.gov.in and the MHA's OCI FAQ PDF, which itself 403s to a direct fetch).
- Three ICAC addresses found this pass (secondary confidence, state-to-centre map still unconfirmed): Washington — 1025 Vermont Avenue NW, Suite 302, 3rd Floor, Washington, DC 20005; New York — 145 West 45th Street, 3rd Floor, New York, NY 10036; San Francisco — 642 Harrison Street, Suite 200, San Francisco, CA 94107.
- From CA, GB, AU, NZ, ZA, BR, AR: the same online application at ociservices.gov.in, submitted through that country's outsourced provider (e.g. VFS) or the Indian mission; the fee is set in local currency by the mission (unverified per country). Filers inside India apply to the FRRO.

Estimates are honest ranges from official fee tables and what families report; where a fee or time could not be confirmed, it says so.
08Where the records live
Where each record lives, and how to ask for it
birth
The Registrar of Births and Deaths of the municipal corporation, municipality or panchayat where the birth was registered (state civil registration system under the Registration of Births and Deaths Act 1969)
The local body of the place of birth; for births after the Civil Registration System went online, the state's CRS portal. Older births (before 1969 registration became compulsory) may be missing: then use other proof of Indian citizenship.

Good to know (3)›
- For OCI, the strongest proof of an ancestor's Indian citizenship is an Indian passport (old passport copies), then an Indian birth certificate, domicile certificate or other official record; the OCI portal accepts parents' or grandparents' Indian passports as proof of Indian origin.
- A relative or representative in India usually has to visit the municipal office; many local bodies do not answer foreign mail. unverified: fees (small, in rupees).
- Documents in a state language need an English translation.

Passport Seva / the Ministry of External Affairs passport records, for an ancestor's old Indian passport
If the family has lost the ancestor's Indian passport, the passport number and issuing office are needed to ask for a record; family papers are usually faster.

English documents need no translation. Indian records in a regional language, and foreign records in other languages, need an English translation (unverified: the VFS checklist's exact standard; a certified translation is the safe choice).

The passport
- Where
- India issues no passport to an OCI cardholder: the OCI (now a digital e-OCI) is used together with the holder's foreign passport. These figures are the OCI card's own fee (USD 275 + USD 3 ICWF + USD 19 VFS) and processing time.

Not legal advice. Postern’s rulebook is written from the statutes and tested against documented cases; where the law is unsettled, the answer says “possible” or “unsure” rather than guess.
